ORDINANCE 2014-01

 AN ORDINANCE AMENDING CHAPTER 4.24 (ORDINANCE 92-4, BUSINESS LICENSES) OF THE MAYFLOWER MUNICIPAL CODE DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

WHEREAS, the City Council of the City of Mayflower, Arkansas has found and determined that the current Business License Ordinance appears to be in conflict with the current Planning and Zoning Ordinance and should be amended to eliminate any appearance of conflict; AND,

WHEREAS, the Mayflower City Council has found and determined that the elimination of any conflict or appearance of a conflict between the City Planning and Zoning Ordinance and the City Business Ordinance is immediately necessary to provide for the health, safety, and welfare of the citizens of the City of Mayflower, and an emergency should be declared to exist;

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MAYFLOWER, ARKANSAS:

         SECTION 1:  That the provisions of Section 4.24.02 of the Mayflower Municipal Code, as adopted by Ordinance 92-4, Section 2 are hereby specifically repealed.  All other sections and provisions of Chapter 4.24, shall remain in full force and effect.

         SECTION 2:  That the provisions of this Ordinance are severable and that if any clause, phrase, or provision of this Ordinance is determined to be invalid it shall not affect the validity of the remainder of the clauses, phrases, or provisions of the Ordinance.

         SECTION 3:  All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of the conflict.

         SECTION 4:  That the Mayflower City Council has found and determined that the provisions of Section 4.24.02 of the Mayflower Municipal Code, as adopted by Ordinance 92-4, Section 2, are in conflict with the provisions of the Mayflower Planning and Zoning Ordinance and the repeal of that section is therefore necessary for the health, safety, and welfare of the citizens of the City of Mayflower, and therefore an emergency is hereby declared to exist and this Ordinance shall be effective from and after its passage and approval.
