Chairman Jana Green-Fornash called the meeting to order at 7:00 PM. Angela Patterson called roll. Commissioners in attendance for the meeting are Jana Green-Fornash, Curtis Lovell, James Oliver, Angela Patterson, Chad Patterson, Sammy Reynolds, Ken Tugwell, and Cliff Wekkin. Delbert Dawson was absent. We have a quorum.
Approval and/or Changes to Minutes: Commissioner C. Patterson made the motion to accept the minutes as printed from the March 10, 2020 regular meeting, and Commissioner Wekkin seconded the motion. The motion passed with all ayes.
General: Harps held their grand reopening June 3, 2020.
New Business: Lamar Advertising applied for a permit to place a billboard on the empty lot north of Shaw Electric. Commissioner Oliver made the motion to table the request until July so that a distance to the next closest billboards could be determined in order to comply with the 1,000 feet separation regulation found in Ordinance 2017-02, and Commissioner Wekkin seconded the motion. The motion passed with all ayes.
Leslie Trischler, 72 North Dogwood, applied for a miscellaneous permit to extend the privacy fence to her front yard to avoid the neighbor’s dogs and to allow more room for her dogs to exercise. Neighbors, James Oliver, Robert Linton, and Ann Linton, proxy for Mr. McGraff, spoke in opposition of the fence, stating the following concerns:
1. legality of the project
2. safety hazards & integrity of the fence from bolts
3. incessant barking of dogs
4. current fence not strong enough to support the proposed addition
5. obstruction of view
6. sunlight would be blocked from garden
7. increased barking from confined dogs
8. unsightly view of fence backing
Because current regulations prevent privacy fencing in front yards, Ms. Trischler was given an application to apply for a variance and a checklist with all requirements, stating a deadline of June 30, would be sent by email the following morning.
Checklist of Items for Board of Zoning Adjustment
❑ Application for Variance – Filed with the Permits Department no less than 15 days prior to the public hearing.
❑ Scale drawing showing the requested variance along with all relevant information – Filed with the Permits Department no later than 15 days prior to the public hearing.
❑ Filing Fee of $100.00 – Paid at the Permits Department no later than 15 days prior to the public hearing.
❑ Sign – A disposable sign is obtained at the Permits Department. The sign must be posted no later than 15 days prior to the public hearing.
❑ Proof of Publication – Obtained from the Log Cabin Democrat after the placement of the public notice. The ad must appear at least once no later than 15 days prior to the public hearing. Filed with the Permits Department.
❑ Certified Letters and/or Petitions to All Owners within 300 Feet – After notification, the postmarked certified receipts and/or return receipts and/or petition are filed with the Permits Department. Notification must be made no later than 15 days prior to the public hearing.
❑ Map showing Property Owners within 300 Feet – A map including the names of property owners. Filed at the Permits Department along with the certified receipts-returns and / or petitions no later than 15 days prior to the public hearing.
Commissioner C. Patterson made the motion to table the request until a July Board of Zoning and Adjustment public hearing could be scheduled. Commissioner Reynolds seconded the motion, passing with all ayes.
Announcements: Chairman Green-Fornash announced the date of July 11th for the next bulk pick up and that residents should not place items curbside before July 1. Chairman Green-Fornash asked for a motion to adjourn the meeting. Commissioner Tugwell made the motion; Commissioner C. Patterson seconded the motion. The motion passed with all ayes. There being no further business, the meeting was adjourned at 7:53 PM.
